Landmark case concerning the breach of privacy won by individuals in sex tape leaked by Nevis police back in 2013.
The 12-paged judgement was handed down this morning for a case where a young man was arrested in 2013.
The police removed the memory card from his phone and accessed it via computer and in doing so, found a sex tape.
The police then proceeded to disseminate the video. The persons involved sued the police and the government.
The woman received a total of $350,000 (approximately) and the man received $150,000 (approximately) because only his manhood was showing whereas the woman’s face was clearly shown in the video.
In the Eastern Caribbean Supreme Court this morning, the two claimants whose sex tape was released on Facebook in 2013, won a judgment of half a million XCD in a matter against the Attorney General & the Chief of Police.
The female claimant was awarded $200,000 for general damages, $100,000 aggravated damages and $50,000 exemplary damages.
The male claimant was awarded $75,000 general damages, $45,000 aggravated damages and $30,000 exemplary damages.
Freedom Fm Newsdesk spoke to Attorney for the Claimants Ms Angelina Sookoo on Monday morning who indicated that the award of half a million dollars was significant and ground breaking.
